Self-Evaluation of Gender Equality in Employment

Notice Prior to Self-Evaluation

To protect the rights of laborers, promote gender equality in employment, and foster a friendly work environment, this self-evaluation is designed to assist all business units to understand and abide by relevant regulations while at the same time elevate the laborers’ working conditions. The main inspection points of the Act of Gender Equality in Employment are listed below. The employers may use this self-evaluation chart to check whether they meet the standards of law.

Our company has prepared the following documents and is fully capable of handling all relevant issues:

  1. Recruitment advertisement.
  2. Work regulations and personnel rules (include educational training, benefits packages, salary management, bonus pay, workplace sexual harassment prevention measures, employee complaint procedure, and reward/punishment system…etc.).
  3. Employee personnel file. (Records the name, sex, date of birth, nationality, education level, address, ID number, on board date, salary, date of joining labor insurance, reward/punishment records, illness/disease condition, and other required facts.)
  4. Attendance record (includes the leaves).
  5. Payroll (includes all calculated items, amount, and sum of the salary of each laborer)
  6. The application procedures of the measures promoting equality in employment (such as menstrual leave, maternity leave…etc.), and the data of the actual number of laborers that have submitted an application within one year.)
  7. Breastfeeding/Breast milk collecting rooms, and childcare facilities or measures.
  8. Records of the employees’ application on Labor Insurance maternity benefits and subsidy for parental leave without pay.

If there are any questions regarding the self-evaluation, the company may contact the local Labor Administration Office in its area (contact information is listed on the website of the Ministry of Labor : Labor Theme/ Labor Standards/ Overview), or dial the Ministry of Labor’s toll-free number 0800-085151 (please call during the hours from 8am to 6pm).

  1. Our company does not discriminate against applicants or employees because of their gender or sexual orientation in the course of recruitment, screening test, hiring, placement, assignment, evaluation or promotion.
  2. Our company does not discriminate against employees because of their gender or sexual orientation in the case of paying salary, retirement, resignation, severance or termination.

Act of Gender Equality in Employment : Article 7, Article 10, and Paragraph 1 of Article 11

No rules or agreements stipulate that the employee has to resign, take leave without pay, or to be filed when getting married, pregnant, giving birth, or raising a child.

Act of Gender Equality in Employment : Paragraph 2, Article 11

Our company has established measures of prevention, correction, complaint and punishment of sexual harassment. These measures are openly displayed in a noticeable place in the workplace.

Act of Gender Equality in Employment : Paragraph 1, Article 13

Our company does not refuse the request of female employees for menstrual leave, and would pay salary in accordance with the law.

Act of Gender Equality in Employment : Article 14

To employees who are in labor or had a miscarriage, our company grants them maternity leave and wages in accordance with the law.

Labor Standards Act : Article 50

When pregnant employees are diagnosed by a physician as needing to recuperate, our company grants them preventing miscarriage leave and wages in accordance with the law.

Regulations of Leave-Taking of Workers: Paragraph 2 & 3, Article 4.

Our company grants employees 5 days of leave for pregnancy checkups during pregnancy.

When an employee’s spouse is in labor, our company grants the employee 5 days off as paternity leave.

Wages shall be paid for pregnancy checkups and paternity leaves.

Act of Gender Equality in Employment: Paragraph 4, 5 &6, Article 15

Our company enables laborers to apply for parental leave without pay.

Act of Gender Equality in Employment: Article 16

Our company does not reject the employee’s reinstatement application after the expiration of parental leave.

Act of Gender Equality in Employment : Article 17

For employees who need to personally feed their babies who are less than two years old or need to collect breast milk, our company provides them 60 minutes a day for feeding or breast milk collection, and an additional 30 minutes when working overtime for an hour or more.

Act of Gender Equality in Employment : Article 18

Our company accepts the requests of family care leaves from employees for the purpose of taking personal care for family members who need inoculation, who suffer serious illness or severe accident.

Act of Gender Equality in Employment : Article 20

Our company does not refuse the request of menstrual leave, maternity leave, miscarriage prevention leave, pregnancy checkup leave, parental leave, family care leave, breastfeeding time, nor to take the mentioned leaves as non-attendance hence to adversely affect the employees' full-attendance bonus payments, evaluation or to take any unfavorable action to the employees.

  1. Our company has established breastfeeding (breast milk collection) rooms in accordance with the items listed in the “Employer Checklist for the Establishment of Breastfeeding (breast milk collection) Rooms for Employees.”
  2. Our company has set up childcare facilities, has signed contract with childcare institutions to provide childcare services, or provide employees with childcare subsidies.

Note: Childcare facilities refer to licensed infant care center, preschool centers, afterschool care centers…etc.
